What Would You Do With $10,000?/ePrize "Grand Prize Drawing" Sweepstakes Official Rules
NO PURCHASE NECESSARY. VOID IN QUEBEC AND WHERE PROHIBITED BY LAW. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
FOR PERSONS WHO ENTER THE GRAND PRIZE DRAWING THROUGH THIS CREATIVE PRESENTATION, THESE RULES GOVERN ALL ASPECTS OF PARTICIPATION AND PRIZE AWARD.
1. Introduction. The What Would You Do With $10,000? Sweepstakes ("eDecoder Game") is sponsored by Palm, Inc., 950 W. Maude Ave., Sunnyvale, CA 94085, U.S.A. The Grand Prize Drawings are sponsored by ePrize, LLC, One ePrize Drive, Pleasant Ridge, MI 48069, U.S.A. Palm, Inc. and ePrize are sometimes collectively referred to as "Sponsors". The Grand Prize Drawings are offered in conjunction with multiple companies ("Promoters") through different Web sites ("Creative Presentations"), announcing many different prizes. One such Promoter is Palm, Inc. One (1) winner will be selected in a random drawing from among all eligible entries received through all Creative Presentations for each of the Grand Prize Drawings applicable to the Promotion. The prize for which an entrant is eligible depends on the Creative Presentation through which the entrant entered the Grand Prize Drawing. Odds of winning a Grand Prize Drawing will depend on the number of entries received in any given Creative Presentation multiplied by the total number of Creative Presentations. The eDecoder Game and the Grand Prize Drawings are referred to collectively as the ("Promotion"). All applicable federal, state, provincial and local laws apply.
ONLY ONE (1) PRIZE ACROSS ALL CREATIVE PRESENTATIONS WILL BE OFFERED IN THE GRAND PRIZE DRAWINGS, SUBJECT TO THE OFFICIAL RULES.
2. Timing. The Promotion begins on October 13, 2006 at 12:00 a.m. Eastern Time ("ET"), and ends on October 13, 2008 at 11:59 p.m. ET ("Promotion Period"). ePrize, LLC's computer is the official time keeping device for this Promotion. Various Creative Presentations may be added throughout the Promotion Period.
3. Eligibility. The Promotion is open to legal residents of the fifty (50) United States (including the District of Columbia) and Canada (excluding Quebec), eighteen (18) years old and older at the time of entry. Employees, officers and directors of Sponsor and Promoters, their respective parents, subsidiaries, and agents, as well as the immediate family (defined as parents, spouses, children, siblings and grandparents) and household members of each such employee, officer and director are not eligible. By participating, entrant agrees to abide by these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Void in Quebec and where prohibited by law.
4. How to Enter. The entry process for both the eDecoder Game and the Grand Prize Drawings are combined.
a. Obtain an eDecoder Game Piece:
i. eDecoder Game Pieces will be distributed within the Tungsten™ E2 Handheld, Palm TX Handheld or Palm Z22 handheld product boxes.
ii. You may also go to palm.eprize.net/decoder/alt to register and obtain an online eDecoder. After registering for the Promotion, you will advance to the online eDecoder Game Page, where you will be provided an online eDecoder.
b. How to use your eDecoder: After obtaining your eDecoder, visit www.palm.com/decoder/ if you have purchased a Tungsten™ E2 Handheld, Palm TX Handheld or Palm Z22 Handheld product and have the serial number handy (or go to palm.eprize.net/decoder/alt if you have not purchased a product) and follow the links and instructions for entry. After you have fully completed the registration form and submitted the required information, you automatically will be entered into the applicable Grand Prize Drawing and you will advance to the eDecoder Game Page. Place your eDecoder over the scrambled image on the screen to reveal whether or not you're a potential instant winner then click the "Next" button to confirm your Game play. To play the Game without obtaining an eDecoder, you can receive a "virtual" eDecoder by indicating you do not have an eDecoder by checking the appropriate box when you register, and following the instructions to advance to the eDecoder Game Page. Your "virtual" eDecoder will appear on the screen. It is recommended that that you install Macromedia Flash on your computer (if you do not already have it) when prompted. Installation is free. Use your mouse to drag the "virtual" eDecoder over the scrambled image to reveal whether or not you're a potential instant winner and then click the "Next" button to confirm your eDecoder Game play. If you do not have the Macromedia Flash 6 Plug-in, you will automatically be taken to a page to see if you are a potential winner. Having Flash will not increase your chance of winning.
Once you click the "Next" button, you will be instantly notified if you are a potential instant winner, and, if so, which prize you have won, subject to verification of eligibility and the terms of these Official Rules. If the notification page indicates that you are a potential instant winner, follow the instructions provided. You will also be sent an email explaining fully how to claim your prize. Odds of winning an eDecoder prize are based on the number of eligible Game plays during the Promotion Period divided by the number of eDecoder prizes.
Limit:. Each entrant may enter/play one (1) time per day during the Promotion Period. Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of plays/entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's plays/entries and that participant may be disqualified. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. Potential winners may be required to show proof of being the authorized account holder. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.
You may enter the Grand Prize Drawing through as many other Creative Presentations as you like, subject to the official rules governing other Creative Presentations.
5. Winner Selection.
a. eDecoder Game. If you are the potential winner of an eDecoder Game prize, you will automatically receive a notification message at the email address you used to register. Forty-Five (45) randomly generated winning times will be created, one for each prize of the eDecoder Game. If you are the first person to play the eDecoder Game at or after one (1) of the winning times, you will be a potential eDecoder Game winner.
b. Grand Prize Drawings. Sponsor will randomly select one (1) Promoter’s Creative Presentation from among all Creative Presentations and Sponsor will then select one (1) potential Grand Prize Winner from among all eligible entries received through the selected Creative Presentation on or around the following dates: April 30, 2007 (the “April 2007 Drawing”); October 31, 2007 (the “October 2007 Drawing”); April 30, 2008 (the “April 2008 Drawing”) and January 31, 2009 (the “January 2009 Drawing”). To be entered into the April 2007 Drawing entries must be received by 11:59 PM ET on March 31, 2007; to be entered into the October 2007 Drawing all entries must be received by 11:59 PM ET on September 30, 2007; to be entered into the April 2008 Drawing entries must be received by 11:59 PM ET on March 31, 2008; and to be entered into the January 2009 Drawing entries must be received by 11:59 PM ET on October 13, 2008. Non-winning entries for each drawing will be entered into subsequent drawings.
c. Requirements of Potential Prize Winners. Entrants must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential Grand Prize Winner will be notified by mail or email within ten (10) days of the drawing. Except where prohibited, the potential winners of the Grand Prize Drawings (parent/legal guardian if winner is a minor in his/her jurisdiction of residence) must sign and return to ePrize, within ten (10) days of being notified, an affidavit of eligibility and liability/publicity release (or Declaration of Compliance, if Canadian resident) in order to claim his/her prize. If the potential winner cannot be contacted within ten (10) days of the first attempt to contact him/her or if he/she fails to sign and return the affidavit of eligibility and liability/publicity release (or Declaration of Compliance, if Canadian resident) within the required time period, prize will be forfeited. An alternate entrant will then be selected in his/her place at random from among all eligible entries received for the selected Creative Presentation. In the event that a winner of any prize is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held after which the applicable prize will remain unawarded. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. If a Canadian resident, a potential winner will be required to correctly answer a time-limited skill testing question without any assistance in order to be eligible to receive a prize. If a potential winner is a Canadian resident and the question is answered incorrectly, the prize will be forfeited. Winners of eDecoder Game or the Grand Prize Drawing who meet all of the eligibility requirements, are verified, and have fully complied with these Rules, will receive their prize within 8-10 weeks after confirming an eligible winning entry.
6. Prizes.
a. eDecoder Game Prizes: FIVE (5) FIRST PRIZES: Palm TX Handheld with Hard Case. ARV: $338.99 USD each. FIVE (5) SECOND PRIZES: Palm Tungsten E2 with Hard Case. ARV: $238.99 USD each. FIVE (5) THIRD PRIZES: Palm Z22 Handheld with Air Case. ARV: $113.99 USD each. THIRTY (30) FOURTH PRIZES: Palm Store Gift Codes ($50). ARV: $50 USD each. Total ARV of eDecoder Game Prizes: $4,959.85 USD. The ARV of electronic prizes is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed. Odds of winning any eDecoder Game Prize are based on the number of eDecoder Game plays during the Promotion Period divided by the total number of prizes available.
b. Grand Prize: One (1) Grand Prize will be awarded for each of the Grand Prize Drawings Dates listed above in Section 5 (b). The prize for which an entrant is eligible depends on the Creative Presentation through which he/she entered. Accordingly, the Grand Prize for a winner who entered through this Creative Presentation will be: Ten Thousand Dollars ($10,000 USD).
For all prizes: Limit: One (1) eDecoder Game prize and one (1) Grand Prize Drawing prize per person. Winners are solely responsible for all federal, state, provincial, and local taxes and other fees associated with prize receipt and use. No other substitution, assignment or transfer of prizes permitted, except by Sponsor or Promoter, who reserve the right to substitute a prize with another prize of greater or equal value if prize cannot be awarded as stated. Sponsor will withhold and/or report taxes as required by applicable law.
7. Publicity. Except where prohibited, participation in the Promotion constitutes winner's consent to Promoter's use of winner's name, likeness, voice, opinions, hometown, state/province and country for promotional purposes in any media without further payment or consideration.
8. General Conditions. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Promotion, including should any virus, bugs, unauthorized human intervention, technical failures or any other factor beyond Sponsor's or Promoter's reasonable control corrupt the administration, security, fairness, integrity or proper operation of the Promotion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other Promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage Sponsor's or any Promoter's Web site or undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws, and, should such an attempt be made, Sponsor and Promoters reserve the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
9. Release. By entering the Promotion or accepting any Promotion prize, each entrant and winner agrees that Sponsor and Promoters (including but not limited to Palm, Inc.), their respective parents, subsidiaries and affiliated companies, and the agents, employees, directors and officers of these companies, are not liable whatsoever for any injuries, losses or damages of any kind resulting in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of any prize or from entrant's or winner's participation in the Promotion.
10. Limitations of Liability. Sponsor and Promoters (including but not limited to Palm, Inc.), are not responsible for: (1) incorrect or inaccurate transcription of entry information or late, lost, stolen, illegible, incomplete, misdirected or postage due entries or entries received through impermissible or illegitimate channels, all of which will be disqualified; (2) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer, network, hardware or software; (3) the unavailability or inaccessibility of any Web site or service; (4) unauthorized human intervention in any part of the entry process or the Promotion; (5) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (6) any injury or damage to persons or property, including but not limited to entrant's computer, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or from downloading any software or material from Sponsor's or a Promoter's Web site(s), regardless of whether the software or material was prepared by Sponsor, a Promoter or a third party, and regardless of whether the software material is connected to Sponsor's or Promoter's Web site by a hypertext link. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Grand Prize Drawing or eDecoder Game play, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsor, in its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
11. Disputes. Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan, U.S.A.; (2) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant, Sponsor and Promoter in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the State of Michigan, U.S.A., without giving effect to any choice of law or conflict of law rules of provisions (whether of the State of Michigan, U.S.A., or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan, U.S.A. All federal, state, provincial and local laws apply.
12. Data Collection. Sponsor and Promoters collect personal information from you when you enter the Promotion. The information collected is subject to the ePrize Privacy Policy, located at www.eprize.com/privacy_policy.html. Information collected shall also be subject to the Privacy Policy of Palm, Inc. at www.palm.com/us/company/privacy.html.
13. Winner's List/Official Rules. For a list of prize winners or a set of Official Rules, send a self-addressed, stamped envelope to "What Would You Do With $10,000?/ePrize Grand Prize Sweepstakes", c/o ePrize, LLC, P.O. Box 8070, Royal Oak, MI 48068-8070, U.S.A. Requests for winner's list must be received by January 13, 2009. Residents of Vermont and Canada may exclude return postage for rules requests.
