The ORG “Messiest Mess” Contest:
1.HOW TO ENTER: Contest begins at 12:01 AM Eastern Time (“ET”) on 12/1/06 and ends at 11:59 PM (ET) on 1/31/07. Limit (1) one entry per person and per household for contest, regardless of entry method. Entries become the property of the Sponsor and will not be returned and may be published and republished in whole or in part, in any media, in perpetuity without compensation. Sponsor has the right to edit and publish all entries, essays, and photographs as it deems fit. No mechanically reproduced entries permitted. Entrants represent that entries are original and previously unpublished and may not violate any third party rights.
Internet Entry: Enter by visiting the Messiest Mess registration page at www.homeorg.com and completing all of the required information and following all instructions. Please include, in 500 words or less, an essay describing your messiest mess and how an ORG solution would help simplify your life. You MUST attach a digital photo of your organizational challenge for your entry to qualify. All of the required fields of the online entry form must be filled out. Online entries (including digital photos) must be submitted by 1/31/2007, 11:59 p.m. (ET) to qualify for the Grand Prize. By submitting the registration form via the Internet, you will opt-in to receive email or other communications from ORG. You may subsequently opt-out of the receipt of such email or communications by following the directions on the entry form page. Your opt-out status will not affect your participation or chances to win this Contest. During the Promotional Period, however, you may nevertheless receive emails which ORG deems are related to the Contest and related programs.
Mail Entry: You can enter by traditional mail by typing no smaller than 12 point font or legibly handprinting on a piece of paper in 500 words or less an essay describing your messiest mess and how an ORG solution would help simplify your life. Your entry must include your name, complete address, and daytime phone number. You MUST also include a photo or two of your organizational challenge. NO photos will be returned to entrant. Entries without photos will not be considered. To mail your entry please affix with sufficient first-class postage and send to: ORG Messiest Mess Contest, 3311 Windquest Drive, Holland, MI 49424. Mail-in entries must be postmarked by 1/31/2007 and received by 2/7/2007 to qualify for the Grand Prize. By registering via traditional mail, you will opt-in to receive mail or other communications from ORG. 2.ELIGIBILITY: Open to legal residents ages 21 and over of the 50 United States and the District of Columbia. Void in Rhode Island, Puerto Rico, and where prohibited by law. Winner must be the owner of the home in which the organizational solution will be installed. No P.O. boxes allowed. Employees of Sponsor, its parents, affiliates and subsidiaries, participating advertising and promotion agencies, and prize suppliers (and members of their immediate family and/or those living in the same of household of each such employee) are not eligible.
3.GRAND PRIZE: One (1) Grand Prize winner will receive an organization solution for an area of his/her home – retail value up to but not to exceed $10,000 including design, delivery, and professional installation. Total prize value will be determined by the extent of the organization solution needs and the cost of product in the winning geographic location. In the event that the organization solution does not total $10,000.00, the winner is not entitled in any way to any additional compensation. Winner will be responsible for paying all associated taxes. The extent of the organization solution needs will be determined by the Sponsor. All materials to be used in the organization solution must be approved by Sponsor prior to the installation. Winner will be responsible for removal of all existing storage and any other items in the area of the home that will receive an organizational solution from ORG. Installation will take place during normal working hours (8:00 am ET – 5:00pm ET) on dates specified by ORG. Winner must agree to have an ORG representative work in his/her home as well as accept delivery of grand prize and allow his/her home to be photographed on dates specified by ORG. The winner must claim the prize within seven (7) days of receipt of notification after the announcement is made. If the winner does not claim the prize in time, another winner will be selected. Any expenses over and above the $10,000.00 prize limit are the responsibility of the winner. Odds of winning depend on the number of eligible entries received.
4.JUDGING FOR GRAND PRIZE: One (1) Grand Prize winner will be selected based on the following judging criteria: On or about February 14, 2007, a qualified panel of ORG Representatives will judge eligible entries on the basis of the home deemed most in need of an ORG solution (50%) and the home with the greatest potential for the most profound organizational improvement (50%). All finalist entries are subject to an on-site inspection by an ORG representative. If ORG believes that the organizational challenge has been purposefully created in any way, the entry will become null and void. The judging panel will announce the final winner using the established judging criteria. All decisions of the judges are final and binding in all respects. The winner will be notified by phone and by registered express mail on or by March 14, 2007. The winner will be announced on or by March 21, 2007, at www.homeorg.com.
5.WINNER'S LIST: For name of winner, available after March 21, 2007, or a copy of the Official Rules, send a self-addressed, stamped envelope (except VT) on or before April 18, 2007, to: ORG “Messiest Mess”, PO Box 469, St. Joseph, MI 49085. Please specify “Official Rules” or “Winner List” on the outer envelope.
6.CONDITIONS OF PARTICIPATION: No transfer, assignment or substitution of a prize permitted. All federal, state, and local laws and regulations apply. Entrants agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this contest. Winner will be required to sign and return an Affidavit of Eligibility, a Liability Release and where legally permissible a Publicity Release within 7 days following the date of first attempted notification. Failure to comply with this deadline may result in forfeiture of the prize and selection of an alternate winner. Winner hereby further agrees that he/she will sign any documents necessary to transfer copyright of the entry to Sponsor within 7 days following the date of first attempted notification. Acceptance of the prize constitutes permission for Sponsor and its agencies to use winner's name and/or likeness, biographical material and/or entry (including an altered form of the entry) for advertising and promotional purposes without additional compensation, unless prohibited by law. By accepting prize, winner agrees to hold Sponsor, its advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representative agents, successors, officers, directors, and employees harmless for any injury or damage caused or claimed to be caused by participation in the Promotion or acceptance or use of the prize. Sponsor is not responsible for any printing, typographical, mechanical or other error in the printing of the offer, administration of the Promotion or in the announcement of the prize.
7.DISPUTES/CHOICE OF LAW: Except where prohibited, by participating contest entrant agrees that: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without regard for conflicts of law doctrine, and all proceedings shall take place in Ottawa County, MI. Except where prohibited, by participating in this Contest, entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest, or awarding of the prize, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Contest but in no event attorneys' fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you. OTHER: Sponsor is not responsible for lost, late, mutilated or illegible entries nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, the Sponsor reserve the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the contest. Caution: Any attempt by a contestant to deliberately damage any website or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such contestant to the fullest extent of the law.
